II. Sources and Categories of Processed Personal Data

  1. The controller processes personal data that you have provided or personal data obtained by the controller based on the fulfillment of your order:
    • first and last name
    • email address
    • postal address
    • billing address
    • phone number
  2. The controller processes your identification and contact data and data necessary for the performance of the contract.

III. Legal Basis and Purpose of Personal Data Processing

  1. The legal basis for processing personal data is:
    • performance of the contract between you and the controller pursuant to Article 6(1)(b) GDPR,
    • compliance with the controller’s legal obligations pursuant to Article 6(1)(c) GDPR,
    • the legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,
    • your consent to processing for direct marketing purposes (especially for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in cases where no order for goods or services has been made.
  2. The purpose of personal data processing is:
    • handling your inquiry or non-binding reservation and subsequent communication leading to the possible conclusion of a contractual relationship between you and the controller; personal data processed through the contact or reservation form are processed to the extent necessary to handle your request and further communication (especially name and contact details). Providing this personal data is necessary for establishing communication and the possible conclusion and performance of a contract; without providing such data, it is not possible to process the request or conclude and perform the contractual relationship on the part of the controller.
    • fulfillment of legal obligations towards the state,
    • sending commercial communications and carrying out other marketing activities.
  3. The controller does not engage in automated individual decision-making within the meaning of Article 22 GDPR.

IV. Data Retention Period

  1. The controller stores personal data:
    • for the period necessary to exercise rights and obligations arising from the contractual relationship between you and the controller and to assert claims arising from these contractual relationships (for a period of 15 years after termination of the contractual relationship).
    • until consent to the processing of personal data for marketing purposes is withdrawn, but no longer than 15 years, if personal data are processed based on consent.
  2. After the retention period expires, the controller will delete the personal data.

V. Recipients of Personal Data (Controller’s Subcontractors)

  1. Recipients of personal data are persons:
    • involved in the delivery of goods/services/payment processing under the contract,
    • providing website operation services and other services related to website operation,
    • providing marketing services.
  2. The controller does not intend to transfer personal data to a third country (a country outside the EU) or to an international organization.

VI. Personal Data Processors

  1. Personal data are processed by the controller, however, the following processors may also process personal data on behalf of the controller:
    • Google Analytics service provider,
    • Google LLC,
    • WordPress content management system,
    • or other providers of processing software services and applications that are not currently used by the controller.

VII. Your Rights

  1. Under the conditions set out in GDPR, you have:
    • the right to access your personal data pursuant to Article 15 GDPR,
    • the right to rectification of personal data pursuant to Article 16 GDPR, or restriction of processing pursuant to Article 18 GDPR,
    • the right to erasure of personal data pursuant to Article 17 GDPR,
    • the right to object to processing pursuant to Article 21 GDPR,
    • the right to data portability pursuant to Article 20 GDPR, and
    • the right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Article III of these conditions.
    • You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated, or to seek judicial remedy.

VIII. Personal Data Security Conditions

  1. The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
  2. The controller has implemented technical measures to secure data storage and storage of personal data in paper form.
  3. The controller declares that only authorized persons appointed by the controller have access to personal data.

IX. Final Provisions

  1. By submitting the form on the website, you confirm that you are familiar with the personal data protection conditions and that you accept them in full.
